OHIO YARD PROS LLC — TERMS OF SERVICE

These Terms of Service (“Terms”) govern all lawn care, landscaping, and related services (“Services”) provided by Ohio Yard Pros LLC (“Ohio Yard Pros,” “we,” “us,” or “our”) to the customer (“you” or “Customer”) at the property listed on your service agreement.
By accepting service from Ohio Yard Pros, you agree to these Terms.
1. Services
Services are described in your individual estimate, quote, or service agreement. Recurring services (such as mowing, fertilization programs, or seasonal cleanup) continue on the agreed schedule until cancelled in writing per Section 10.
2. Scheduling
We provide service on the day of week assigned to your property (e.g., “Mondays”), weather and operating conditions permitting. We do not guarantee specific arrival times. Crews typically operate between 8 AM and 7 PM.
You will be notified by email or text if service is delayed beyond your assigned day.
3. Property Access
- All gates must be unlocked on your scheduled service day.
- All pets must be secured indoors during the service window.
- If we cannot access the property due to a locked gate, unsecured pet, or other access issue, the visit will be skipped and the full service charge still applies. We will attempt to contact you and reschedule if time and route allow.
4. Property Preparation
Please remove the following from lawn areas before your service window:
- Children's toys, sporting equipment, and lawn furniture
- Pet waste
- Hoses, sprinklers, and irrigation flags (unless permanently installed)
- Yard debris not contracted for cleanup
A $35 cleanup fee may be assessed if debris prevents service or requires our crew to relocate items, at the discretion of the on-site crew.
5. Weather and Rescheduling
Service may be delayed or rescheduled due to:
- Rain, lightning, or saturated ground conditions
- Excessive heat or unsafe operating conditions
- Equipment failure or crew availability
Ohio Yard Pros reserves the right to reschedule any service up to 2 calendar days after the originally scheduled date. If we are unable to complete service within that window, a prorated refund will be issued for the missed visit, or the visit may be credited toward your next billing cycle at your option.
We do not mow during active lightning, heavy rain, or when ground conditions would cause turf damage.
6. Property Damage
We take care to protect your property, but the nature of mowing, trimming, and landscape work carries inherent risk of incidental contact with surrounding features.
Ohio Yard Pros is not responsible for damage to:
- Unmarked irrigation heads, drip lines, or buried wiring (invisible dog fences, low-voltage lighting, etc.)
- Decorative items, garden ornaments, or landscape lighting not clearly visible
- Fences, siding, or structures damaged by debris thrown by mowers despite reasonable precaution
- Existing damage to turf, hardscape, or landscape features documented prior to service
- Pet waste or items left in service areas
We will promptly repair or compensate for damage caused by operator negligence. Damage claims must be reported in writing within 7 days of the service date and will be assessed by Ohio Yard Pros.
Customers are responsible for marking buried utilities, irrigation components, and invisible fence boundaries before initial service.
7. Pesticide and Fertilizer Applications
Where applicable, chemical applications are performed by licensed applicators in accordance with Ohio Department of Agriculture regulations. You will receive:
- Advance notice when chemical applications are scheduled
- Written notification of products applied (as required by Ohio law)
- Posted application flags on treated areas
Please keep children and pets off treated areas for the time period specified on application notices (typically 24 hours, or until product has dried).
8. Payment Terms
- Invoices are issued monthly (or at the time of service for one-time jobs).
- Payment is due within 15 days of invoice date.
- Accepted payment methods: ACH transfer, credit/debit card, check.
- A late fee of $15 or 1.5% per month (whichever is greater) applies to balances over 15 days past due.
- Services may be suspended for accounts more than 30 days past due. A reactivation fee of $50 may apply.
- Returned checks are subject to a $35 fee.
9. Pricing and Rate Changes
Recurring service rates are guaranteed for the calendar year. Ohio Yard Pros reserves the right to adjust rates annually with 30 days written notice prior to the effective date.
Additional services beyond the recurring agreement (extra cleanups, storm debris, additional plantings, etc.) will be quoted separately and require approval before work begins.
10. Cancellation
Either party may cancel recurring services with 7 days written notice (email is acceptable). Notice received less than 7 days before a scheduled service will result in that service being completed and billed as normal.
Pre-paid seasonal packages are non-refundable after the first service of the season has been performed, but unused services may be credited toward future work.
11. Liability and Insurance
Ohio Yard Pros maintains general liability insurance and, where applicable, commercial pesticide application coverage. Proof of insurance is available upon request.
Our liability for any claim is limited to the amount paid by the Customer for the specific service in question. We are not liable for indirect, consequential, or incidental damages.
12. Photography
Ohio Yard Pros may photograph completed work for use in marketing, social media, and portfolio materials. Photographs will not include identifying information (addresses, vehicles, or persons) unless specifically authorized by the Customer in writing. To opt out of photography of your property, notify us in writing.
13. Communication
By providing your phone number and email, you consent to receive service-related communications (scheduling, invoices, weather updates) via text, email, and phone. You may opt out of marketing communications at any time while remaining enrolled for transactional notifications.
14. Disputes
Any disputes will first be addressed through good-faith communication between Customer and Ohio Yard Pros. Unresolved disputes will be governed by the laws of the State of Ohio and venued in Warren County, Ohio.
15. Modifications
Ohio Yard Pros may update these Terms with 30 days notice sent by email. Continued use of services after the effective date constitutes acceptance of the updated Terms.
